These Terms and Conditions set out the basis on which Rubbish Removal Belgravia provides rubbish removal and related waste collection services. By making a booking, accepting a quotation, or allowing our team to carry out work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you must not use our services. These terms apply to both residential and commercial customers, except where stated otherwise.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

We reserve the right to decline to remove certain items, including but not limited to hazardous waste, chemicals, asbestos, medical waste, gas bottles, explosives, and any other items that we reasonably consider unsafe, illegal to handle, or outside our standard service offering.

All services are carried out subject to applicable UK waste management regulations and industry codes of practice, and we will dispose of waste using licensed and appropriate facilities.

Booking Process

You can request a booking by contacting us via telephone, email, or any booking system we make available. You must provide accurate and complete information about the property, access, type and approximate quantity of waste, and any special requirements.

Any quotation we provide is based on the information you supply. If, upon arrival, the actual volume, weight, or nature of the waste differs significantly, or if access is more difficult than described, we may revise the quotation, apply additional charges, or decline the work.

A booking is not confirmed until we have accepted your request and provided you with a confirmation, which may be given verbally, in writing, or by electronic message. By confirming the booking, you agree to these Terms and Conditions.

We may ask for photographic evidence of the waste or property in order to provide an estimate. Any such estimate is indicative only and may be adjusted on site once our team has inspected the waste.

Access and Customer Responsibilities

You are responsible for ensuring that we have safe and reasonable access to the premises and to the waste to be collected at the agreed date and time. This includes arranging any necessary parking, entry codes, keys, building access, and permissions required for us to perform the services.

If we are unable to access the premises or the waste due to reasons beyond our control, including lack of parking, locked doors, or incorrect address details, we may charge a call-out or cancellation fee to cover our costs.

You must ensure that the waste to be removed is clearly identified and separated from any items you wish to keep. We will not be liable for removing items that you failed to distinguish from waste.

You agree not to include any prohibited, hazardous, or illegal materials in the waste. If such materials are discovered, we may refuse to remove them, charge additional costs for safe handling, or suspend the services.

Pricing and Quotations

Unless otherwise stated, our charges are based on factors such as the volume and type of waste, weight, labour involved, access conditions, and any additional services requested. Prices are normally quoted excluding VAT, which will be added where applicable in accordance with UK law.

Any quotation we provide is valid for the period specified in the quotation or, if no period is stated, for 14 days from the date of issue. We may withdraw or amend a quotation at any time before a booking is confirmed.

If during the service we are asked to remove additional waste not included in the original quotation, or if we encounter unexpected difficulties, we may adjust the price accordingly. We will inform you of any such adjustments before proceeding, where reasonably possible.

Payments and Invoicing

Unless otherwise agreed in writing, payment is due immediately upon completion of the services. We may require payment in advance or a deposit to secure your booking, particularly for larger clearances or commercial work.

We accept various payment methods, which may include cash, card, bank transfer, or other methods notified to you at the time of booking. We are not obliged to release receipts or documentation until payment has been received in full.

For approved commercial customers, we may offer invoicing terms. In such cases, payment must be made within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

If you fail to pay any amount owed on time, we may charge interest on overdue sums at the statutory rate permitted under UK law and recover any reasonable costs incurred in pursuing payment. We also reserve the right to suspend or withdraw services until all outstanding amounts are settled.

Cancellations and Changes

You may cancel or amend your booking by giving us reasonable notice. We ask that you notify us of any cancellations or changes as soon as possible to allow us to manage our schedule efficiently.

If you cancel a booking more than 24 hours before the scheduled start time, no cancellation fee will normally apply. If you cancel within 24 hours, or if we arrive on site and are unable to carry out the work due to factors within your control, we may apply a cancellation or call-out fee to cover lost time and costs.

If we need to cancel or rearrange your booking due to operational reasons, staff availability, vehicle issues, or circumstances beyond our reasonable control, we will notify you as soon as practicable and offer an alternative time. We will not be liable for any indirect or consequential losses arising from such changes.

Service Delivery and Timeframes

We will use reasonable efforts to attend your premises and carry out the services at the agreed time. However, all dates and times are estimates only and may be affected by traffic, weather, access delays, or other operational issues.

Time is not of the essence in relation to our attendance or completion of the services, and we will not be liable for delays that are outside our reasonable control. We will keep you informed of any significant delays whenever possible.

Waste Handling and Regulations

We operate in accordance with applicable UK waste management laws and regulations, including duty of care requirements, and we take reasonable steps to ensure that waste is transferred to licensed disposal or recycling facilities.

By engaging our services, you confirm that you have the right to dispose of the waste and that it has not been obtained illegally or in breach of any third-party rights.

We may refuse to remove waste that we reasonably believe to be hazardous, contaminated, illegal, or otherwise not suitable for our standard rubbish removal services. Where possible, we may suggest alternative options for lawful disposal, but we are under no obligation to handle such materials.

Customer Conduct and Safety

You agree to behave courteously and to ensure that anyone on your premises does not obstruct or endanger our staff or vehicles. Abusive, threatening, or unsafe behaviour may result in immediate suspension or termination of the services, and cancellation fees may apply.

For safety reasons, you must not instruct our staff to carry out tasks outside the agreed scope, such as structural alterations, working at unsafe heights, or moving items that pose an unacceptable risk. Our staff may decline any request that they consider unsafe or inappropriate.

Liability and Limitations

We will exercise reasonable care and skill in providing the services. However, you acknowledge that rubbish removal and waste collection may involve moving bulky or awkward items through confined spaces, and minor incidental damage may occur despite our reasonable efforts to avoid it.

We will not be liable for pre-existing damage, wear, or defects at your premises, or for damage arising from your failure to provide accurate information or adequate access. You should remove or protect fragile items and surfaces in areas where our team will be working.

Our total liability for any loss or damage arising from or in connection with the services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific service in relation to which the claim arises, except in cases where liability cannot be limited under UK law.

We will not be liable for any indirect, consequential, or economic losses, including loss of profits, loss of business, loss of data, or loss of opportunity, arising out of or in connection with the services or these Terms and Conditions.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Claims and Complaints

If you have a concern or complaint about our services, you should notify us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, rectify the issue.

Any claims for damage or loss must be reported to us in writing with reasonable details and supporting evidence, within 7 days of completion of the services, or within 7 days of when you first became aware of the issue. We may not be able to consider claims raised outside this period.

We will review your complaint and respond within a reasonable time. Our decision will take into account the evidence provided and our obligations under these Terms and Conditions and applicable law.

Insurance

We maintain appropriate insurance cover for our rubbish removal operations, in line with common industry practice in the UK. This may include public liability and employer's liability insurance.

Our insurance is subject to the policy terms, conditions, and exclusions of the relevant insurers. These Terms and Conditions do not extend or increase our liability beyond what is provided under applicable law and the contract between us.

Data Protection and Privacy

We may collect and process personal information such as your name, contact details, address, and payment information for the purpose of providing our rubbish removal services, managing bookings, and complying with legal obligations.

We will handle your personal data in accordance with UK data protection legislation and use it only for legitimate business purposes, such as delivering the services, handling enquiries and complaints, and meeting regulatory requirements.

We take reasonable measures to safeguard your information against unauthorised access, loss, or misuse. You may contact us to request details of the personal data we hold about you and to exercise your rights under applicable data protection laws.

Termination

We may terminate the contract or suspend services immediately if you materially breach these Terms and Conditions, including non-payment, providing misleading information, refusing safe access, or including prohibited items in the waste.

Upon termination, you will remain liable for all amounts due up to the date of termination and for any reasonable costs incurred as a result of your breach.

Amendments to Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements. The version in force at the time of your booking or confirmed quotation will apply to that specific service.

We may publish updated terms or otherwise make them available upon request. Your continued use of our services after any changes take effect will constitute your acceptance of the revised terms.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.

Severability

If any provision or part-provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision or part-provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation we provide, constitute the entire agreement between you and us relating to the provision of rubbish removal and waste collection services, and supersede any prior discussions, correspondence, or understandings.

You acknowledge that you have not relied on any statement, promise, or representation that is not expressly set out in these Terms and Conditions or the written documents forming part of the contract.
